Making a Will is almost certainly one of the most important things you can do to preserve your wealth, protect your loved ones and ensure their future financial security.

Below are just some of the reasons to make a Will:

However, disinheriting someone under your Will does not necessarily stop them from making a claim on your estate after your death. Our experience

Married couple in their early 50s

Our clients A and B are a married couple in their early 50s. They have two children, C (25), who is independent, and D (22), who has a severe learning disability and requires ongoing care. They were concerned about ensuring D was financially secure after they die, without affecting his entitlement to benefits.

They came to us due to the extensive experience we have in dealing with these situations. It was thought that D would be unlikely to be able to manage his finances due to his disability and we explained that by leaving him a lump sum outright, he could lose his eligibility for certain means-tested benefits and could be vulnerable to third parties wanting to take advantage of him.

We advised A and B to each put in place discretionary trust Wills to protect D’s inheritance. The trust would be managed by appointed trustees who would ensure that the funds were used for D’s benefit, such as paying for his care, living expenses, and any other needs. The trustees would have discretion over how and when to release funds to D, thereby avoiding the funds being held by him directly.

A and B also wanted to ensure their daughter C received a fair share of their estate. By using discretionary trust Wills they were able to state how their assets were to be divided between C and D and could allocate a portion of the estate for D’s long-term needs, while ensuring C received her inheritance without complications.

Well-drafted wills can allow for changes in the future, such as the possibility of D’s needs changing over time. A discretionary trust Will provides flexibility, as trustees can adapt to D’s circumstances and also changes in legislation.

Married couple in their 60s

Our clients A and B are a married couple both in their 60s. They have been married for 35 years and have two adult children, C and D, both of whom are involved in the family business.

During their marriage, they have amassed significant assets including, their family home worth £850,000, a farm with agricultural land and buildings worth £1.5 million, a manufacturing business worth £5 million, bank accounts and investments worth £1.25 million and personal items worth £175,000.

A and B wish to ensure that their children are taken care of and that their businesses are passed on smoothly whilst making the most of any available tax reliefs, especially Agricultural Property Relief (APR) and Business Property Relief (BPR).

We advised A and B to each put in place discretionary trust Wills as this would enable the trustees to seek advice at the time of the first death as to the most tax efficient way of dealing with the estate of the first to die. The trustees, who could be the survivor and their two children, would have discretion over how to structure the estate, taking into account the deceased’s wishes as set out in a side letter to the trustees and any changes in legislation.

We advised A and B to keep their wills under regular review and that he trustees seek advice following the first death, to ensure the estate of the first to die was dealt with in the most tax efficient manner.

At the same time as advising on their wills, we also advised them on lifetime tax planning options which looked at reducing their estates for inheritance tax (IHT) purposes, whilst taking into account any capital gains tax (CGT) implications. Having such a broad range of tax experience within the team meant that all areas of personal taxation were advised on.

Why make a will?

Making a will is very important to have control over how your estate is distributed. They are legally binding documents that overrule the Intestacy rules. The Intestacy rules determine the distribution of a person’s assets in the event they die without leaving a Will. A Will can be used to appoint guardians for your children, if you dies whilst they are under the age of 18, to arrange your estate in the most tax efficient way; to disinherit people who would benefit under the Intestacy rules if you don’t leave a Will appoint the right people to administer your estate and ensure your assets pass to those you wish to benefit. Having a Will also helps avoid delays in the granting of probate.

Reason 1 – Control over the distribution of your assets
A will allows you to specify who you want to receive your assets, such as your property, money, and personal belongings and at what age you would like them to inherit.

Reason 2 – Appointing executors
You can choose the individuals you trust to act as your Executors. They will be responsible for administering your estate and ensuring your wishes are carried out.

Reason 3 – Guardianship of minor children
A will enables you to appoint guardians for your minor children, ensuring that they are cared for by people you trust. Without a will, the court will decide who will look after your children, and they may not choose those you would want to act.

Reason 4 – Minimising family disputes
