Our client, Ms A, was defending an application for international child abduction before the Royal Courts of Justice. It was alleged that the child had been abducted without the consent of the other parent. The said parent was seeking for the child to be returned to their jurisdiction of birth.
The potential impact on the client would have been life changing. They had settled in the UK, as a family, and the threat of these proceedings potentially could have resulted in the family having to internationally relocate. There were two issues we needed to prove: – 1) that the client had the other parents’ consent to stay in the UK; and 2) whether the child in question was a habitual resident of the UK.
We successfully defended the application, and the client and her family were permitted to remain in the UK. We successfully proved that the client had obtained consent to remain in the UK and had shown that they have now become a habitual residence in the UK, supported within up-to-date case law. Our client was overjoyed with the result, securing a future for her family in the UK.
