What is a lasting power of attorney (LPA)?

A Lasting Power of Attorney is a legal document that allows you to appoint one or more attorneys to make decisions on your behalf if you lose the ability to make those decisions yourself.

Creating an LPA does not prevent you from managing your own affairs while you have mental capacity. Instead, it provides protection for the future and ensures that trusted individuals are able to act if required.

There are two types of Lasting Power of Attorney:

Financial decisions LPA – This allows your attorneys to manage your property and financial affairs. Depending on your preferences, it can be used while you still have mental capacity with your consent, or only if you lose capacity in the future.
Health and care decisions – This allows your attorneys to make decisions about your health, care and welfare if you are unable to make those decisions yourself. This can include decisions about medical treatment, care arrangements and, if you choose life-sustaining treatment.

What is the difference between a general power of attorney and a lasting power of attorney?

A general power of attorney is only valid while you as the donor of the power has mental capacity, and they are typically used for specific financial decisions, such as the sale of a house. On the other hand, a lasting power of attorney, continues to be valid even if you as the donor loses mental capacity.

How do I make a lasting power of attorney (LPA)?

You must complete an LPA form, either online or on paper, which must then be signed by you, your attorneys and witnesses and a certificate provider. The LPA must be registered with the Office of the Public Guardian (OPG) before it can be used.
