Public Law offences covers a variety of circumstances and is used to prevent the use of violence/intimation by people or groups.

Examples:

  • Riot – this offence relates to 12 or more people who used unlawful violence for a common purpose and their conduct is such that a person of reasonable firmness would have feared for their own safety. The maximum penalty is 10 years custody and it is an Indictable only matter so can only be dealt with at the Crown Court.
  • Violent Disorder – this offence relates to 3 or more people in the same circumstances as above other than the requirement for a ‘common purpose’. This has a maximum punishment of a 5-year custodial sentence and is triable either-way.
  • Affray – this offence relates to using unlawful violence on another and that caused them to fear for their safety. This has a maximum punishment of a 3-year custodial sentence.
  • S4 Public Order Act Offence – triable summarily ie only at the Magistrates Court. Various conduct can relate to this offence including verbal threats, missiles being thrown and incidents of violence. Maximum sentence is 6 months custody.
  • S4 A Public Order Act Offence – an offence which requires the intention to cause harassment, alarm or distress and there must be evidence of someone feeling the same. Maximum sentence is 26 weeks custody.
  • Racially, Religiously Aggravated offences- This is when an offence is said to have been aggravated by racial or religious hostility. These matters can be dealt with in by either the Magistrates or Crown Court and the sentencing is uplifted to reflect the above.
  • Causing disturbance on NHS premises- This new provision, means causing disturbance or nuisance on NHS property can result in a level 3 fine (£1000). To be charged with this offence, you must refuse without a reasonable excuse to leave the premises, and not be on the premises to receive medical attention.
