Our trust law expertise

Setting up trusts

There are a variety of reasons for creating a trust, including:
  • Protecting your property and assets from tax and care home fees
  • Passing on your wealth to future generations in a tax efficient manner
  • Providing for disabled relatives and vulnerable children
  • Allowing you to gift assets to your children, while protecting your family’s wealth from divorce or bankruptcy.

Whatever your goals, our specialist trust solicitors and tax advisors can advise on creating a wide range of trust structures to match your needs, including bare trusts, interest in possession trusts and discretionary trusts.

Advice for trustees

Acting as a trustee carries significant responsibility with clearly defined duties. Our team can advise you on every aspect of your role, including:

  • Understanding your duties as set out in the trust documents
  • Effective management of money and/or assets held in trust
  • Ensuring you are always acting in the beneficiary’s best interests
  • Dealing with tax issues, including payment of Income Tax, Inheritance Tax and Capital Gains Tax, where appropriate
  • Reporting to HMRC
  • Dealing with trust disputes

Advice for beneficiaries of trusts

If you are the beneficiary of a trust, you need to be confident that the trust is being managed in a way that matches your best interests. If you have any concerns about how a trust is being managed, our expert team can advise you on whether there may be an issue and your legal options if so.

Trust disputes

Disputes over trusts can be complicated, meaning they are often time-consuming, frustrating and expensive to deal with. Our team can provide clear, pragmatic advice to help resolve trust disputes amicably wherever possible, saving time, money and stress.

However, where an amicable agreement cannot be reached, we can also support you in starting or defending court action if required.

Specialist solicitors for the elderly

We offer specialist legal advice for the elderly and families living with dementia.

As one of the most established and experienced elderly care solicitors in the region, we understand how difficult it can be to come to terms with the diagnosis of dementia and other mental health conditions.

Our team are highly qualified solicitors who help clients who have life-changing diagnoses and work hard to look for positive legal solutions for the future.

For more information, visit our dementia information page, where you can find access to resources and more information about what our team can do to help you plan for the future.

Our trust advice fees

Fixed fee trust services

We can offer fixed fees for some work relating to trusts, such as the drafting of trust documents.
