A pre-partnership agreement involves a financial disclosure of both parties’ assets and determines what will happen to savings, property, and other finances if the couple dissolves their civil partnership at a later date.

Are prenuptial agreements legally binding in the UK?
Prenups are not strictly legally binding in the UK. Depending on the circumstances, they will not hold up in course in every case. Regardless, prenuptial agreements can afford couples legal protection in many cases. An agreement can be upheld in Court during divorce proceedings, providing specific conditions are met.
A prenuptial agreement is more likely to hold up in Court if:
- Both spouses received independent legal advice before they signed the prenuptial agreement
- Both spouses fully disclosed their finances and all assets when the prenuptial agreement was created
What should be included in a prenup?
Prenuptial agreements tend to include details of each spouses’ assets. While prenups agreements are tailored to each individual couple and what they would like to include, a typical prenup covers:
- Property, whether owned by individuals, or jointly as a couple
- Premium bonds and savings
- Businesses or business interests
- Pensions, shares, and stocks
- Income and any other assets
Who should get a prenuptial agreement?
If you would like to protect your assets before entering into marriage, you are advised to get a prenuptial agreement, or a pre-partnership agreement for civil partners.
Such agreements are especially advised for individuals with significant wealth and assets to protect, however, anyone can benefit from drafting a prenup for the basis of asset protection later on.
Can I get a prenuptial agreement after getting married?
No, it is not possible to get a prenuptial agreement after getting married, however, it is possible to get a post nuptial agreement.
A post nuptial agreement works in exactly the same way as a prenup, the one difference is that this agreement is drafted once the couple is already married, as opposed to before.
How do you make a prenuptial agreement?
To draft a prenup, or a partnership agreement, you’ll need to work with an expert solicitor. A lawyer will be able to offer support to create an agreement that best suits your circumstances and offers financial protection.
