What is probate?

When someone passes away, banks and financial providers may require a Grant of Probate before releasing or transferring the deceased’s assets. A Grant of Probate is a legal document issued by the Probate Registry. It confirms who is authorised to administer the estate.

If there is a valid Will, the named executors apply for the grant. If there is no Will, the administrators, usually next of kin or beneficiaries, apply instead. To obtain the grant, details of all assets and liabilities must be provided and inheritance tax forms may need to be completed.

Once the grant is issued, assets can be collected or sold, debts settled and the estate distributed to beneficiaries. In some cases, income or capital gains tax matters may also need to be addressed, including personal or estate tax returns.
