Theft is the taking of another individual’s property without consent. It does not involve the breaking and entering of another property. There are certain elements that must be proved, which include:
Dishonesty- It is a requirement that you were dishonest.
Appropriates- Any assumption of the rights of an owner amounts to appropriation, this includes keeping property which may have initially come from being honest.
Property- Property does not have to just be physical objects it can be monies from a bank account.
Belonging to another- It must be proved that the property was not yours and belonged to another individual.
Intending to permanently deprive- The last requirement is for the prosecution to prove that you intend to take the property permanently and keep it for yourself.
Theft can be dealt with either at the Magistrates or Crown Court and carries a sentence of up to 7 years custody.
