If your company has been struck off the register of companies it may be possible to restore the company to the register.
Once a company is struck off the register of companies at Companies House it loses its separate legal identity and is dissolved and its remaining assets are passed to the Crown, the Duchy of Lancaster or the Duke of Cornwall (depending on location). But what happens if business continues to trade, or the company owns property, or has the benefit of certain rights over a title, or a third party has an unresolved claim against the company and wants to take action?
There are certain circumstances in which you will be able to restore the company to the register, recover assets from the Crown and continue as if the company had never been struck off.
There are two ways in which this can happen, by court order or administrative restoration, and the route taken will depend on a number of factors including the reasons for the company’s restoration and who is applying to have the company restored.
