Summer is here. Many of us are packing our suitcases, sorting out passports, and looking forward to some much-needed time away. But while you’re ticking off sun cream and flip-flops, it’s worth asking: is your family legally prepared if something unexpected happens while you’re away?
This isn’t about being gloomy, it’s about giving yourself peace of mind so you can truly relax.

Do you have a Will in place?
A valid Will ensures that your wishes are followed, and your loved ones are protected, no matter what happens. Even if you’re young, fit and healthy, having a Will in place before travelling can avoid confusion or distress for your family later. It’s particularly important for parents of young children, blended families, or anyone with assets or property.
What if you can’t make decisions for yourself?
A Lasting Power of Attorney (LPA) lets you choose who can make decisions on your behalf if you’re ever unable to do so, whether due to illness, injury, or an accident abroad. You can have separate LPAs for financial decisions and for health and care decisions.
Imagine you were in hospital abroad, unconscious or confused, and someone needed to speak up for you or deal with your affairs back home. Would the right person be legally able to act? LPAs make sure they can.
Is there a child travelling? You may need written consent
If a child is travelling with one parent, with grandparents, friends, or as part of a school trip, many countries now require written consent from a parent or guardian. This is particularly true after Brexit.
A simple, signed letter confirming who the child is travelling with, and your contact details, can save time at border control and help avoid unnecessary panic or delays.
Are there elderly or vulnerable relatives who need to be cared for while you’re away?
If you’re going on holiday and leaving behind elderly or vulnerable relatives, now is the time to make sure they have everything they need.
- Do they have an up-to-date LPA for health and care, appointing trusted people in case anything should happen whilst you are away? (You should always appoint more than one attorney where possible, for situations such as attorneys going on holiday.)
- Are their medical and emergency contact details easily accessible?
- Do they have enough medication to last them until you return?
- Can they get their shopping? If not, can you plan a delivery?
Store your documents securely and make them accessible
It’s no good having a Will or LPA if no one knows where it is.
- Keep copies in a secure but accessible place.
- Let your loved ones know where to find them.
- Consider digital backups or registration services.
